Terms and Conditions for Riders

By participating in a ride or tour provided by Cruizzy (hereinafter referred to as "the Service"), you (hereinafter referred to as "the Rider" or "you") agree to be bound by the following terms and conditions. Please read these terms carefully before using the Service.

1. Acceptance of Terms:
Your participation in any ride or tour offered by the Service constitutes your full and unconditional acceptance of these Terms and Conditions. If you do not agree with any part of these terms, you may not use the Service.

2. Safety and Conduct:
Riders must follow all instructions and directions given by the Service's personnel, including drivers and tour guides. Riders are required to wear seatbelts at all times while the LSV is in motion. Failure to comply may result in the termination of the ride without refund.

The following are strictly prohibited: littering or damaging the LSV in any way; engaging in disruptive, disrespectful, or unsafe behavior towards other riders, Service personnel, or the public; extending any part of your body outside the LSV while it is in motion; tampering with the LSV's controls or equipment.

Riders are responsible for complying with all applicable local, state, and federal laws and regulations.

The Service's driver has the right to refuse service to anyone who, in their reasonable judgment, poses a safety risk to themselves or others, or who violates these Terms and Conditions.

3. Bookings and Payments:
Advance bookings may be required or recommended for certain tours. The Service reserves the right to limit the number of riders on any given ride or tour. Payment for the Service is due at the time of booking or as otherwise specified by the Service. Accepted payment methods will be clearly communicated.

Cancellation policies and refund eligibility will be provided at the time of booking. Generally, cancellations made with sufficient notice may be eligible for a full or partial refund. The Service reserves the right to cancel or modify tours due to unforeseen circumstances (e.g., weather, mechanical issues) and will make reasonable efforts to notify Riders and offer alternative arrangements or refunds. Riders who fail to show up for a booked ride or tour without prior notice may forfeit their payment.

4. Limited Accessibility for Handicapped or Disabled Riders:
Riders are advised that the Service's LSV(s) may have limited accessibility for individuals using wheelchairs, walkers, or other mobility aids. Due to the design and operational characteristics of LSVs, certain physical limitations may make boarding and riding difficult or impossible.

Individuals with mobility challenges or disabilities are strongly encouraged to contact the Service prior to booking to discuss their specific needs and the suitability of the Service for their circumstances. Service personnel will provide accurate information about vehicle dimensions, step height, and any other relevant accessibility features.

While Service personnel will offer reasonable assistance where possible, they may not be equipped or permitted to provide extensive physical assistance with boarding, disembarking, or securing mobility aids. Riders who require significant assistance should be accompanied by a personal care attendant who can provide the necessary support.

The safety of all riders is paramount. Service personnel reserve the right to refuse service to individuals whose mobility needs cannot be reasonably accommodated without compromising the safety and operational integrity of the Service or the safety of other riders.

The Service does not guarantee full and unrestricted accessibility for all handicapped or disabled riders. By booking and participating in the Service, you acknowledge and accept these limitations.

5. Assumption of Risk and Liability Waiver:
Riders acknowledge that riding in an LSV and participating in tours involves certain inherent risks, including but not limited to accidents, collisions, uneven road surfaces, weather conditions, the actions or omissions of other individuals, and challenges related to boarding and disembarking, particularly for individuals with mobility limitations.

You voluntarily choose to participate in the Service with full awareness of these risks, including the limitations on accessibility.

To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue Cruizzy, its owners, officers, employees, agents, and affiliates (collectively, "the Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury (including death) that may be sustained by you, or to any property belonging to you, whether caused by the negligence of the Released Parties or otherwise, while participating in the Service, including any issues related to the limited accessibility of the LSV.

6. Indemnification:
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your breach of these Terms and Conditions, or your negligence or willful misconduct, including any claims arising from difficulties related to your accessibility needs.

7. Photography and Videography:
The Service may take photographs or videos during rides and tours for promotional purposes. By participating in the Service, you grant the Service the right to use your image and likeness in such materials without any compensation to you. If you do not wish to have your image used, please notify Service personnel at the beginning of your ride or tour.

8. Personal Belongings:
The Service is not responsible for any loss, theft, or damage to your personal belongings brought onto the LSV. Riders are solely responsible for their possessions.

9. Modifications to Terms and Conditions:
The Service reserves the right to modify these Terms and Conditions at any time without prior notice. The latest version of the Terms and Conditions will be posted on the Service's website or otherwise made available. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms and Conditions.

10. Governing Law and Dispute Resolution:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms and Conditions shall be exclusively resolved in the state or federal courts located in [Specify County, Oregon].

11. Entire Agreement:
These Terms and Conditions constitute the entire agreement between the Rider and the Service with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.

12. Severability:
If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

By participating in the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the limitations regarding accessibility for handicapped or disabled riders.
